Baliwag, Bulacan. Last December 17, 2019, LGU Baliwag Mayor Ferdinand V. Estrella signed Executive Order (EO) No. 059, s. 2019 entitled Guidelines in the Issuance of Business License/Permit for Head Offices and Branches of Pawnshops (PSs) and Money Service Businesses (MSBs), and Information Sharing with the Bangko Sentral ng Pilipinas.
This is in line with Section 2 of Ease of Doing Business and Efficient Delivery of Government Services Act (RA 11032), which states that the State shall maintain honesty and responsibility among its public officials and employees, and shall take appropriate measures to promote transparency in each agency with regard to the manner of transacting with the public, which shall encompass a program for the adoption of simplified requirements and procedures that will reduce red tape and expedite business and non-business related transactions in the government; and Department of the Interior and Local Government (DILG) and Bangko Sentral ng Pilipinas Joint Memorandum Circular No. 1, Series of 2019 issued on November 15, 2019 prescribing enhanced guidelines on the policies and procedures on the issuance and renewal of business license/permit of PSs and MSBs in consideration of the new registration procedures issued by the BSP; also it institutionalizes and ensures the effective implementation and monitoring of the information sharing between LGUs and the BSP pursuant to the MOA between the DILG and the BSP.
Section 1 of EO 059, s. 2019 prescribes guidelines for the issuance of business license or permit for Head Offices and Branches of Pawnshops (PSs) and Money Services Businesses (MSBs). The specific line of business shall be indicated in the business license or permit.
For new applicant of business license or permit for head and branches of PS and MSB, the Municipality shall issue business license or permit with the following conditions stated in the business permit:
For Head Office:
“Subject to registration with the Bangko Sentral ng Pilipinas (BSP) prior to the start of operations.”
“Subject to notification to the Bangko Sentral ng Pilipinas (BSP) by the head office within five (5) working days from the start of each office’s operations, and issuance by the BSP of branch code.”
For renewal of business license or permit of BSP-registered entities, the Municipality shall require the presentation of a copy of the following documents:
For Pawnshop (PS):
- Head Office: Certificate of Authority (COA) , or valid Provisional Certificate of Authority (PCOA)
- Branches: BSP Letter on the Issuance of Code for MSB offices other than the Head Office
For Money Service Business (MSB):
- Head Office: Certificate of Registration (COR), or valid Provisional Certificate of Authority (PCOA)
- Branches/Other Offices: BSP Letter on the Issuance of Code for MSB offices other than the Head Office
EO 059, s. 2019 likewise provides information sharing with the Bangko Sentral ng Pilipinas (BSP), specifically, the Municipality through the custodian of records of business registration shall submit to the BSP a report duly certified by the Municipal Mayor or its duly authorized representative, containing the following information on the PSs and MSBs:
- Those with new business licenses/permits;
- Those with renewed business licenses/permits;
- Those which failed to renew their business licenses/permits; and
- Those which business permits/ licenses were cancelled/ revoked/ retired.
According to the Order, all processing of personal data shall be conducted in compliance with the provisions of RA No. 10173 (Data Privacy Act of 2012) and its corresponding Implementing Rules and Regulations.
