Election Protest Laban kay Mayor Ferdie Tuluyan ng Ibinasura ng Korte

Baliwag, Bulacan – Tuluyan na ngang ibinasura ng husgado ang inihaing reklamo ni Dr. Carolina Dellosa laban kay Mayor Ferdie V. Estrella matapos na ito ay idismiss ni Judge Mirasol Dychinco ng Malolos RTC Branch 21 dahil sa kakulangan nito ng mga mahahalagang elemento na kailangan sa pagsasampa ng kaso.

Matapos nga na ito ay ibasura ng korte ay naghain ng Motion for Reconsideration ang kampo ni Dellosa at ipinatatanggal si Judge Dychinco sa kaso. Agad namang nagbitiw ang huwes kaya’t muling naraffle ang kaso sa Branch 14 ngunit hindi ito tinanggap ng huwes dahilan upang muling iraffle ang kaso na bumagsak sa sala ni Judge Alexander Tamayo ng Branch 15

Ang sipi ng Desisyon na isinulat ni Judge Alexander Tamayo at ikalawang huwes na tuluyang nagbasura sa electoral protest na isinampa ni Dellosa laban kay Mayor Ferdie.

“Under rule 2, sec. 7 thereof, the election protest or petition for quo warranto shall be filed within the non-extendible period of ten (10) days counted from the date of proclamation. Being a prohibited pleading under Rule 6 of the SC Circular, the motion for reconsideration should outright be denied.”

Besides, this court only proceeded to hear and resolve the motion for reconsideration which was the pending incident before RTC branch 20, before it was reraffled to branch 14 on June 3, 2019 and reraffled again to this court on June 10, 2019 Being a prohibited act.”
